Organizational Context

The Legal Specialist will be responsible for providing legal advisory services to UNDP Country Office and UNDP projects to enhance the efficiency of operations across Pakistan. This will include (i) supporting all levels of management to effectively and efficiently discharge their responsibilities within the CO, and (ii) assisting programmatic and operational management activities at project level. Both sets of activities aim to enable UNDP Pakistan to become a ‘best practice ‘organization within the evolving framework of UNDP rules and regulations. It is also anticipated that a portion of the Legal Specialist’s time would be spent in supporting new and emerging areas of intervention with partners of the Governance Unit.

Under the direct supervision of the Country Director and working closely with the two Deputy Country Directors and Strategic Management Team of UNDP Pakistan, the Legal Specialist will be responsible for the tasks described below.

Summary of Key Functions:

1. Support UNDP Pakistan, as well as the projects funded by UNDP, with legal advice and action on legal matters (normally, would occupy 85% of the time);

1.1. Advise UNDP and Projects funded by UNDP as to the legal rights of UNDP as a party to the contracts with project staff, with implementing parties/partners/donors and legal obligations with regard to contractual compliance;

1.2. Assist UNDP and Projects funded by UNDP on legal issues to protect the organization’s interests including copy rights, physical assets, liabilities, use of financial/technical resources, expendable/non-expendable properties;

1.3. Help prepare/review and clear contracts, agreements including cost sharing and other legal documents to be signed by UNDP and projects, especially legal advice on complex procurement cases in compliance with UNDP rules and procedures.

1.4. Review and analyze past legal precedents and cases and prepare letters and other appropriate documents related to legal issues arising out of interaction with central/local authorities, ministries, committees, partners, contractors and other counterparts;

1.5. Provide technical support, legal advice and representation services for cases referred for arbitration, mediation and conciliation in line with international standards and requirements of UNDP’s relevant global policies and procedures;

1.6. Review necessary statutes/acts/ordinances/bills, local legal norms, legislation documents and other appropriate documents, track changes in national legislation pertaining to relevant work of UNDP;

1.7. Represent UNDP as a legal Specialist to deal with representatives from central/local authorities, ministries and committees on the issues concerned, as necessary, to support programmatic and operational activities;

1.8. Advise related to application and compliance of UN conventions signed by the host country and technical guidance to UNDP;

1.9. Provide technical input and act on matters in the pertinent areas of international law relevant to the work of UNDP;

1.10. Arrange provision of advisory services through international and national experts;

1.11. Lead on documentation of legal services provided to UNDP and project staff particularly with regard to contract management issues;

1.12. Arrange support from the Office of Audit and Investigations and the Legal Office of UNDP HQs.

1.13. Organize training for CO and project staff in pursuit of the above objectives.

2. Support UNDP’s development initiatives in the law and justice sector with focus on human rights and access to justice (normally, would occupy 15% of the time):

2.1. Keep abreast of and analyze relevant legal developments as they relate to the operations of international donor organizations;

2.2. Support the Governance Unit in the area of law reforms particularly the administrative justice, access to justice and legal empowerment of the poor etc;

2.3. Organize training activities to disseminate best practices stemming from the work of the UN system institutions and bodies, international organizations and think tanks working on legal issues;

2.4. Contribute to information campaigns and other legal literacy activities in the field of rule of law, democratization and human rights; contribute to United Nations’ human rights advocacy efforts.
